Terms of Service
Your agreement with Bluefundr.
1. Acceptance of terms
By accessing or using Bluefundr ("the platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the platform.
These Terms are a legally binding agreement between you and Bluefundr Ltd. Please read them carefully.
2. About Bluefundr
Bluefundr is a platform that helps sports clubs and community organisations raise money and run their club online. Depending on what your club chooses to use, the platform provides:
- Club lotto: a weekly online lotto with one-off and recurring entries, jackpot roll-over and automated draws.
- Memberships: tools for clubs to publish membership plans and collect membership fees online.
- Fundraising competitions: paid-entry prediction competitions (for example Golden Goal, Correct Score, Perfect Strike) where entry fees are split between fundraising and prizes.
- Facility bookings: tools for clubs to take paid bookings for pitches and other facilities.
- Custom events: the ability for a club to create its own event or match and run a competition based on it.
Bluefundr provides the software, payment collection and reporting tools. Clubs remain responsible for how they run their own lotto, memberships, competitions, bookings and events.
3. Eligibility and age requirements
To use Bluefundr you must provide accurate registration information, have the legal capacity to enter into contracts, and comply with all applicable laws.
- You must be at least 16 years of age to hold a Bluefundr account.
- You must be at least 18 years of age to enter any paid fundraising competition or to buy club lotto entries, because these are forms of gambling under Irish law.
- Clubs and organisers must be a registered club, organisation or charity, or an authorised representative acting on its behalf.
4. Account registration and security
Account creation
You must create an account to access most features. You agree to provide accurate, current and complete information, keep it up to date, and keep your login credentials secure and confidential. Notify us immediately of any unauthorised access.
Account responsibility
You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorised use of your account where that use was not caused by us.
5. Responsibilities of clubs and organisers
If you set up a club to collect money on Bluefundr, you are the organiser. You are responsible for running your activities lawfully and honestly, and in particular you agree that:
- You will comply with all gambling, lottery, fundraising, consumer and tax laws that apply to your activities.
- The entry fees, prizes, membership prices, booking prices and rules you publish are accurate and clearly displayed.
- You will deal fairly with your members, entrants and bookers, and will handle any complaints or refunds relating to your own activities.
- You will keep any personal data you receive about your members, entrants and bookers safe and use it only for legitimate club purposes.
Paid-entry competitions and club lotto are lotteries under the Gambling Regulation Act 2024. They may only be operated by a registered club, organisation or charity that either holds a valid lottery permit or licence, or qualifies for an exemption under the applicable regulations. When you set up your club to run these, you confirm that you meet these requirements. Where a licence or permit is provided it is reviewed by Bluefundr; small-scale fundraising exemptions are self-certified and Bluefundr does not verify exemption eligibility.
6. Fundraising competitions
General rules
- Each competition has specific rules set by the organiser, shown when you enter.
- Entry fees and prize structures are clearly displayed before you pay.
- Entries must be submitted before the stated deadline.
- Winners are determined by the competition-specific criteria.
Fair play
You agree to play fairly and honestly, not to use automated systems or bots, not to manipulate or attempt to manipulate results, and not to share accounts or entries with others.
Any suspected fraudulent activity may result in immediate account suspension and potential legal action.
How results are determined
For competitions based on professional fixtures, results are calculated automatically using data supplied by third-party sports data providers.
- For football (soccer) competitions, all scores and results are based on the outcome at the end of normal time only (90 minutes). Extra time and penalty shootouts do not count.
- For GAA competitions, scores are based on the final result as officially published, which includes extra time if played. Penalty shootout results do not affect the score for any competition type.
- Once results are published, they are final and cannot be reversed.
Match cancellation and alternate matches
Sports events may be postponed, cancelled or abandoned for reasons beyond our control. Matches abandoned during play, or cancelled before kickoff, are treated as cancelled immediately. A match that is postponed or suspended and does not resume within 3 hours is also treated as cancelled.
When you create a competition, pre-selected alternate matches are automatically assigned based on the competition type. If a primary match is cancelled, the system replaces it with the next available alternate, and this continues until the alternates are exhausted.
- Multi-event competitions (Perfect Strike, Super 8): up to 3 alternate matches can replace cancelled matches. Predictions for a cancelled match are deactivated and predictions for its alternate become active. If all alternates are used, you receive 0 points for any remaining cancelled match and the competition continues.
- Last Man Standing: if your selected match is cancelled you receive a bye and progress to the next round, but you cannot select that team again in future rounds.
- Single-event competitions (Golden Goal, Over the Bar): 1 alternate match can replace a cancelled match. If the alternate is also cancelled, the winner is determined by a random draw from all participants.
Random draw
Where a single-event competition exhausts its alternates and goes to a random draw, all participants who entered are eligible, the winner is selected randomly from all valid entries, participants are notified, and prizes are distributed according to the original competition structure.
When results were determined by random draw, the competition page may show a "reveal winner" animation. This visual spinner is for entertainment only.
- The winner is decided at competition closure using a cryptographically secure random number generator.
- All valid entries are included in the actual draw pool.
- The animation may show only a representative subset of names and does not reflect the actual selection process or order.
- The winner shown was already determined before any animation is displayed.
7. Custom events and club-entered results
Clubs can create their own custom events or matches (for example a local club fixture that is not covered by our sports data providers) and run a competition based on that event.
For a custom event, the club that created it is solely responsible for entering the correct result. Bluefundr does not source, verify or validate the result of a custom event. Winners are calculated from the result the club enters.
Bluefundr is not liable for any incorrect, incomplete or delayed data entered by a club for a custom event, or for the outcome of any competition based on that data. Any dispute about the result of a custom-event competition is between the entrants and the club that ran it, and should be raised with that club.
8. Club lotto
Clubs can run a weekly online lotto. Supporters can buy one-off entries or set up a recurring entry that renews automatically for each draw until cancelled.
- Club lotto is a lottery and is available only to entrants aged 18 or over.
- The club sets the price per line, the numbers or format, the jackpot and any rules, which are shown before you enter.
- If there is no jackpot winner in a draw, the jackpot may roll over to the next draw where the club has set it up to do so.
- Recurring entries are charged automatically before each draw. You can cancel a recurring entry at any time from your account, and cancelling stops future charges. Entries already paid for a draw that has taken place are not refundable.
- Draws and winners are handled by the platform on the club's behalf, but the club remains the promoter of its lotto and is responsible for prize payment.
9. Memberships
Clubs can publish membership plans and collect membership fees through Bluefundr. When you buy a membership, you are entering into a membership arrangement with the club, not with Bluefundr.
- The club sets its membership plans, prices, any family or youth pricing, and what each membership includes.
- Bluefundr provides the tools to publish plans, take payment and keep a record of members for the club.
- Membership benefits, eligibility and any refunds are a matter between you and the club. Bluefundr is not responsible for the benefits a club does or does not provide.
- The club is the controller of its members' personal data. Bluefundr processes that data on the club's behalf to provide the service. See our Privacy Policy.
10. Facility bookings
Clubs can offer pitches and other facilities for paid booking through Bluefundr. When you book, you are entering into a booking arrangement with the club that owns or manages the facility.
- The club sets its facilities, availability, prices and booking rules, which are shown before you pay.
- Payment is taken at the time of booking. Bookings are non-refundable unless the club states otherwise.
- Access to the facility, its condition and safety, and any dispute about a booking are a matter between you and the club.
11. Payments, fees and payouts
Payment processing
Payments are processed through Stripe, our third-party payment provider, using Stripe Connect. By using Bluefundr to collect money, clubs agree to Stripe's Connected Account Agreement and Services Agreement. Money raised is paid out to the club's connected Stripe account.
Fees
Bluefundr charges fees for the services a club uses. The fees that apply are shown to the club before it collects money and are available on request. Payment processing charges from Stripe may also apply.
You acknowledge that Stripe may, at its sole discretion, request verification documents, place holds or reserves on funds, delay or block payouts, or suspend a payment account. Bluefundr is not liable for actions taken by Stripe in relation to your account, including fund holds, payout delays or restrictions. Disputes about payment processing must be resolved directly with Stripe.
Prizes and prize distribution
Prizes are allocated according to competition or lotto rules. We facilitate payouts to clubs, who are solely responsible for distributing prizes to winners. Bluefundr cannot be held responsible for a club's non-payment of prizes.
12. Prohibited conduct
You agree not to:
- Violate any applicable law or regulation.
- Infringe intellectual property rights.
- Transmit harmful, offensive or inappropriate content.
- Attempt to gain unauthorised access to our systems, or interfere with or disrupt the service.
- Create multiple accounts to circumvent restrictions.
- Engage in money laundering or other financial crime.
- Use the platform for illegal gambling activity.
13. Content and intellectual property
You retain ownership of content you submit but grant us a licence to use, display and distribute it for the operation of the platform. All platform content, including software, design and branding, is owned by Bluefundr and protected by intellectual property laws. Sports data, team names and league information are used under appropriate licences and permitted-use provisions under Irish and EU law.
14. Privacy and data protection
Your privacy matters to us. Our Privacy Policy explains how we collect, use and protect your information. By using the platform you consent to our data practices as described there. We comply with the EU General Data Protection Regulation and respect your rights over your personal data.
15. Disclaimers and limitation of liability
Service availability
We aim for high availability but cannot guarantee uninterrupted service, and we are not liable for temporary outages or technical issues.
Third-party dependencies
The platform relies on third-party services such as payment processors and sports data providers. We are not responsible for their failures or disruptions.
Results and technical limitations
Results for competitions based on professional fixtures are calculated automatically from third-party data. While we strive for accuracy, technical errors can occur. For custom events, results are entered by the club and are the club's responsibility, as set out in section 7. You acknowledge that we are not liable for errors caused by technical failures, third-party data errors, or data entered by a club, and that we may, but are not obliged to, provide goodwill compensation in cases of significant technical error on our part.
Organiser responsibility
Bluefundr is a platform provider. Clubs should verify results before distributing prizes and remain solely responsible for final prize decisions and distribution.
To the extent permitted by law, our liability to you is limited to the amount you paid us for our services in the 12 months preceding a claim. We are not liable for indirect, incidental or consequential damages.
Exclusions
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Irish law.
16. Indemnification
You agree to indemnify and hold harmless Bluefundr, its officers, directors, employees and agents from any claims, damages or expenses arising from your use of the platform or your breach of these Terms.
17. Termination
You may close your account at any time by contacting our support team. We may suspend or terminate your account if you breach these Terms or our policies, engage in fraudulent or illegal activity, fail to pay required fees, or pose a risk to other users or the platform. On termination your right to use the platform ends immediately, and we may retain certain information as required by law or for legitimate business purposes.
18. Dispute resolution and governing law
These Terms are governed by Irish law and any disputes are subject to the exclusive jurisdiction of the Irish courts. We encourage resolving disputes through direct communication, and support mediation through recognised Irish mediation services for unresolved issues.
19. Changes to these terms
We may update these Terms from time to time. We will notify users of material changes by email, by a prominent notice on the platform, and by posting the updated Terms on our website. Continued use after changes take effect constitutes acceptance of the updated Terms.
20. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and Bluefundr. We may assign these Terms to a successor entity; you may not assign your rights without our written consent.
