Your agreement with Bluefundr
1. Acceptance of Terms
By accessing or using Bluefundr ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
2. Description of Service
Bluefundr is a platform that enables organisations and individuals to create fundraising competitions where participants can enter predictions, compete for prizes, and support charitable causes. Our services include:
- Competition creation and management tools
- Secure payment processing
- Participant entry and prediction systems
- Prize notification and fundraising management
- Analytics and reporting features
3. Competition Types
Bluefundr supports two distinct types of competitions, each with different legal requirements and operational models:
Pay-To-Enter Competitions (For Licensed Organisations)
These competitions:
- Charge entry fees to participants
- Collect fundraising on the platform
- Require organisers to undergo licence verification before creation
- Must comply with all applicable gambling and lottery regulations
- Are available only to eligible organisations (sports clubs, charities, registered groups)
Private Competitions (Free-Entry Prediction Games)
Private competitions are free-entry prediction games designed for friends, family, work colleagues, and private groups. These competitions:
- Have no entry fee (participants enter for free)
- Handle no money or prizes on the Bluefundr platform
- Provide tracking, approvals, and automated leaderboards only
- Do not require lottery licenses or permits
- Require a small competition setup fee to access the platform features
Private competitions on Bluefundr are designed for friendly prediction tracking among groups. The platform provides competition management and result tracking only. Any separate arrangements made between participants are entirely independent of Bluefundr and remain the responsibility of those involved.
4. Eligibility
To use Bluefundr, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into contracts
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations
- Not be prohibited from using our services under Irish or EU law
5. Account Registration and Security
Account Creation
You must create an account to access most features. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access
Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for any loss or damage from unauthorized use of your account.
6. Competition Rules and Participation
General Rules
- Each competition has specific rules set by the organiser
- Entry fees and prize structures are clearly displayed
- Entries must be submitted before stated deadlines
- Winners are determined based on competition-specific criteria
Fair Play
You agree to:
- Play fairly and honestly
- Not use automated systems or bots
- Not manipulate or attempt to manipulate results
- Not share accounts or entries with others
Match Cancellation Policy
Sports events may be postponed, cancelled, or abandoned due to circumstances beyond our control. The following rules apply:
- Abandoned or Cancelled Matches: Matches abandoned during play or cancelled before kickoff are immediately treated as CANCELLED and the alternate match system activates
- Postponed or Suspended Matches: If a match is postponed or suspended and does not resume within 60 minutes, it is treated as CANCELLED and the alternate match system activates
Alternate Match System
Bluefundr uses an alternate match system to handle cancelled or abandoned matches. When you create a competition, pre-selected alternate matches are automatically assigned based on your competition type:
- Single-Event Competitions (Golden Goal, GAA Correct Score): 1 alternate match is assigned
- Multi-Event Competitions (Perfect Strike, Correct Score): 3 alternate matches are assigned
If a primary match is cancelled, the system automatically replaces it with the next available alternate. This process continues until all alternates are exhausted.
Competition-Specific Impact
When a match is cancelled or abandoned, matches are replaced with alternates when available. If all alternates are exhausted, the impact depends on your competition type:
- Correct Score (Multi-Event): Up to 3 alternate matches can replace cancelled matches. Your predictions for the cancelled match are deactivated, and your predictions for the alternate match become active. If all 3 alternates are exhausted, you receive 0 points (not penalized) for any remaining cancelled matches and the competition continues.
- Perfect Strike (Multi-Event): Up to 3 alternate matches can replace cancelled matches. Your predictions for the cancelled match are deactivated, and your predictions for the alternate match become active. If all 3 alternates are exhausted, the jackpot is disabled and you receive 0 points for any remaining cancelled matches.
- Golden Goal (Single-Event): 1 alternate match can replace a cancelled match. Your minute allocations remain unchanged—the same minutes apply to whichever match is active. If the alternate is also cancelled, the winner is determined by random draw from all participants.
- GAA Correct Score (Single-Event): 1 alternate match can replace a cancelled match. Your predictions for the cancelled match are deactivated, and your predictions for the alternate match become active. If the alternate is also cancelled, the winner is determined by random draw from all participants.
Random Draw Process
When a single-event competition (Golden Goal or GAA Correct Score) exhausts all alternate matches and enters a random draw:
- All participants who entered the competition are eligible for the draw
- The winner is selected randomly from all competition entries
- Participants are notified of the situation and the random draw outcome
- Prize distribution follows the original competition structure

7. Payments and Fees
Entry Fees
Competition entry fees are clearly displayed and must be paid at the time of entry. All payments are processed securely through Stripe.
Platform Fees
We charge organisers a platform fee for our services. This fee structure is transparent and available upon request.
Prize Distribution
Positions and prizes are allocated according to competition rules. We facilitate payments to organisers, who are solely responsible for prize distribution. Bluefundr cannot be held responsible for organiser non-payment.
8. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our services
- Create multiple accounts to circumvent restrictions
- Engage in money laundering or other financial crimes
- Use our platform for illegal gambling activities
9. Content and Intellectual Property
Your Content
You retain ownership of content you submit but grant us a licence to use, display, and distribute it for platform operations.
Our Content
All platform content, including software, design, and branding, is owned by Bluefundr and protected by intellectual property laws.
Third-Party Content
Sports data, team names, and league information are used under appropriate licences and permitted use provisions under Irish and EU law.
10. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Platform, you consent to our data practices as described in our Privacy Policy.
11. Disclaimers and Limitation of Liability
Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for temporary outages or technical issues.
Third-Party Dependencies
Our platform relies on third-party services (payment processors, data providers). We are not responsible for their failures or disruptions.
Automated Results and Technical Limitations
Competition results are determined automatically by our platform using data from third-party sports data providers. While we strive for accuracy, technical errors may occasionally occur in result calculation or winner determination.
You acknowledge and agree that:
- Once results are published and prizes distributed, they are final and cannot be reversed
- We are not liable for errors in result calculation caused by technical failures, data provider errors, or system malfunctions
- Winners are not required to return prizes even if results are later found to be incorrect
- We reserve the right, but are not obligated, to provide goodwill compensation in cases of significant technical errors
Limitation of Liability
Exclusions
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded by Irish law
12. Indemnification
You agree to indemnify and hold harmless Bluefundr, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Platform or violation of these Terms.
13. Termination
By You
You may terminate your account at any time by contacting our support team.
By Us
We may suspend or terminate your account if you:
- Violate these Terms or our policies
- Engage in fraudulent or illegal activities
- Fail to pay required fees
- Pose a risk to other users or our platform
Effect of Termination
Upon termination, your right to use our Platform ceases immediately. We may retain certain information as required by law or for legitimate business purposes.
14. Dispute Resolution
Governing Law
These Terms are governed by Irish law. Any disputes will be subject to the exclusive jurisdiction of Irish courts.
Alternative Dispute Resolution
We encourage resolving disputes through direct communication. For unresolved issues, we support mediation through recognized Irish mediation services.
15. Changes to Terms
We may update these Terms periodically. We will notify users of material changes by:
- Email notification to registered users
- Prominent notice on our platform
- Posting updated terms on our website
Continued use after changes constitutes acceptance of updated Terms.
16. Miscellaneous
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bluefundr.
Assignment
We may assign these Terms to a successor entity. You may not assign your rights without our written consent.
